    ## 1. Introduction


    Welcome to Make It Write ("the Service," "we," "us," or "our"), a book writing and publishing platform operated by Differson LLC. These Terms of Use ("Terms") govern your access to and use of the Make It Write mobile application, website, and all related services.


    By creating an account, accessing, or using Make It Write, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.


    Important: These Terms include provisions that limit our liability, require arbitration of disputes, and contain an AI-generated content disclaimer. Please read them carefully.

    ## 2. Account Registration & Eligibility


    ### 2.1 Age Requirement


    You must be at least 13 years of age to create an account and use Make It Write. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian.


    ### 2.2 Account Information


    When registering for an account, you must:


    - Provide accurate, current, and complete information

    - Maintain and promptly update your account information

    - Keep your password secure and confidential

    - Notify us immediately of any unauthorized access to your account


    You are responsible for all activities that occur under your account.


    ### 2.3 Account Types


    Make It Write offers the following account types:


    - Free Account: Limited access to basic features

    - Starter Plan: Enhanced writing tools and limited AI generation

    - Creator Plan: Full access to AI book generation and publishing features

    - Super Plan: Premium features with unlimited AI generation and priority support


    ### 2.4 One Account Per User


    You may only create and maintain one account. Multiple accounts created by the same person may be suspended or terminated.

    ## 3. Subscription Plans & Payments


    ### 3.1 Subscription Tiers


    Make It Write offers the following subscription plans:

    Pricing is subject to change with 30 days' advance notice.


    ### 3.2 Payment Terms


    - Subscriptions are billed monthly or annually (if available) in advance

    - Payments are processed through Apple App Store, Google Play Store, or Stripe

    - You authorize us to charge your payment method at the beginning of each billing period

    - Failed payments may result in service suspension


    ### 3.3 Free Trial


    We may offer free trial periods for subscription plans. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.


    ### 3.4 Cancellation


    You may cancel your subscription at any time through:


    - Your Apple App Store or Google Play Store account settings

    - Your Make It Write account settings

    - Contacting support at contact@differson.net


    Upon cancellation:


    - You will retain access until the end of the current billing period

    - No refunds will be provided for the remaining subscription period (except as specified in Section 6.5.3)

    - Your account will revert to Free tier after the subscription expires


    ### 3.5 Automatic Renewal


    Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You will be charged the then-current subscription rate.

    ## 4. User-Generated Content & Ownership


    ### 4.1 Your Content


    "User Content" means any content you create, upload, submit, or store using Make It Write, including:


    - Story prompts and writing inputs

    - Book manuscripts and drafts

    - Cover art and images

    - Author profiles and bios

    - Comments and reviews

    - Any other text, images, or data you provide


    ### 4.2 Ownership of Your Content


    You retain all ownership rights to your User Content. Make It Write does not claim ownership of any content you create using the Service.


    ### 4.3 License to Make It Write


    By submitting User Content to Make It Write, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:


    - Store, process, and display your content to provide the Service

    - Use your content to train and improve our AI models (anonymized and aggregated only)

    - Display your published books to other users within the Make It Write library

    - Create backups and copies for service reliability


    This license exists only for the purpose of operating and improving the Service and terminates when you delete your content (except for cached or backup copies retained for up to 30 days).


    ### 4.4 Published Books


    When you choose to publish a book within Make It Write:


    - Your book will be visible to other Make It Write users (unless set to private)

    - Users may read, favorite, or share your published books

    - You retain the right to unpublish or delete your books at any time

    - Readers may lose access to unpublished books


    ### 4.5 Responsibility for Content


    You are solely responsible for your User Content. You represent and warrant that:


    - You own or have the necessary rights to all User Content you submit

    - Your content does not violate any third-party rights (copyright, trademark, privacy, etc.)

    - Your content complies with all applicable laws and these Terms

    ## 5. AI Book Generation Service


    ### 5.1 AI Writing Assistant


    Make It Write uses artificial intelligence (powered by OpenAI GPT models and other AI technologies) to:


    - Generate book ideas and titles based on your chat conversations

    - Assist with story development and plot creation

    - Generate complete book manuscripts from user prompts

    - Suggest character development and dialogue

    - Provide writing style recommendations


    ### 5.2 How AI Generation Works


    1. Input: You provide prompts, story preferences, or conversation history

    2. Processing: Our AI analyzes your input and generates creative content

    3. Output: AI-generated book content is delivered to you for review and editing

    4. Ownership: You receive full rights to the AI-generated output (subject to Section 6.4)


    ### 5.3 AI Model Providers


    Make It Write currently uses the following AI providers:


    - OpenAI (GPT-4, GPT-4 Turbo): For story generation and writing assistance

    - Anthropic Claude: For enhanced creative writing (planned)

    - Stable Diffusion / DALL-E: For cover art generation (planned)


    AI providers are subject to change without notice. We will always use industry-leading AI models to ensure quality.


    ### 5.4 Generation Limits


    - Free: No AI generations

    - Starter: 5 AI book generations per month

    - Creator: Unlimited AI book generations

    - Super: Unlimited AI book generations + priority processing


    Unused generations do not roll over to the next billing period.


    ### 5.5 Generation Quality


    Make It Write strives to provide high-quality AI-generated content, but:


    - AI output may require human editing and refinement

    - Generated content quality may vary based on input prompts

    - We do not guarantee specific word counts, writing styles, or narrative structures

    - AI may occasionally produce inconsistent or nonsensical content


    You are responsible for reviewing and editing all AI-generated content before publication.

    ## 6. User Rights & Responsibilities


    ### 6.1 Acceptable Use Policy


    You agree to use Make It Write only for lawful purposes and in accordance with these Terms. You agree NOT to:


    - Violate any applicable local, state, national, or international law

    - Infringe upon the rights of others (copyright, trademark, privacy, publicity, or other proprietary rights)

    - Harass, abuse, threaten, or intimidate other users

    - Distribute viruses, malware, or other harmful computer code

    - Engage in any conduct that restricts or inhibits anyone's use of the Service

    - Use the Service for any commercial purpose not explicitly authorized by these Terms


    ### 6.2 Content Guidelines


    All User Content must comply with the following guidelines:


    Prohibited Content Types:


    - Illegal Content: Content that violates any law or regulation

    - Hate Speech: Content promoting hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics

    - Violence: Excessive violence, gore, or content promoting self-harm

    - Sexual Content: Pornographic, sexually explicit, or adult content involving minors

    - Harassment: Content intended to harass, bully, or intimidate individuals

    - Spam: Repetitive, unsolicited, or promotional content

    - Misinformation: Deliberately false or misleading information that could cause harm

    - Impersonation: Pretending to be another person or entity


    Age-Appropriate Content:


    Make It Write is a general-audience platform. Content should be suitable for readers aged 13 and above. Mature themes (violence, romance, mild language) are permitted if appropriate for a teen/adult audience, but explicit sexual or graphic violent content is prohibited.


    ### 6.3 Prohibited Activities


    You may NOT:


    - Create multiple accounts to circumvent service limitations

    - Share your account credentials with others

    - Use automated scripts, bots, or tools to access the Service

    - Reverse engineer, decompile, or attempt to extract source code from the Service

    - Remove or modify any copyright, trademark, or proprietary notices

    - Use the Service to generate content for resale or third-party services without authorization

    - Scrape, data mine, or harvest user data without permission

    - Attempt to gain unauthorized access to other users' accounts or data

    - Interfere with or disrupt the Service or servers


    ### 6.4 Book Copyright & Commercial Use


    #### Commercial Use Authorization


    Users who generate books using Make It Write's AI book generation service retain the right to use, distribute, and monetize their generated books for commercial purposes, subject to the following conditions:


    #### Permitted Commercial Uses:


    - Self-Publish: Publish books on Amazon Kindle Direct Publishing (KDP), Apple Books, Barnes & Noble Press, Kobo, and other self-publishing platforms

    - Print-on-Demand: Create physical book copies through services like IngramSpark, Lulu, or Amazon KDP Print

    - Traditional Publishing: Submit AI-generated manuscripts to literary agents or traditional publishers (disclosure of AI use may be required by publisher)

    - Serial Publication: Publish books in serialized formats on platforms like Wattpad, Medium, Substack, or your own website

    - Audiobook Distribution: Convert books to audiobook format and distribute on Audible, Google Play Audiobooks, Apple Books, etc.

    - Translation and Adaptation: Translate books into other languages or adapt into other formats (screenplay, graphic novel, etc.)

    - Merchandise: Create merchandise based on your books (t-shirts, posters, etc.)

    - Licensing: License your books for use in film, TV, games, or other media


    #### Required Attribution:


    Users are encouraged (but not required) to disclose AI use when commercially distributing AI-generated books:


    - "Written with assistance from Make It Write AI"

    - "AI-assisted storytelling powered by Make It Write"

    - Or similar attribution language


    Note: Some publishing platforms (e.g., Amazon KDP) may require disclosure of AI-generated content. You are responsible for complying with platform-specific requirements.


    #### Copyright Ownership:


    - You own the copyright to the creative input (prompts, story concepts, character development, plot outlines) provided to the AI

    - You receive a license to the AI-generated textual output

    - Make It Write retains no ownership rights to books generated by users

    - You may register copyrights for AI-generated books in your own name, where legally permitted (subject to evolving AI copyright law)


    #### Third-Party Rights & Responsibilities:


    - You are solely responsible for ensuring your use of AI-generated books does not infringe on third-party rights

    - You must obtain any necessary licenses for quotes, excerpts, or copyrighted elements you add to AI-generated books

    - Make It Write provides no warranties regarding the originality or copyright status of AI-generated books

    - You indemnify Make It Write against any claims arising from your commercial use of AI-generated books


    #### Commercial Distribution Platforms:


    - Users may distribute AI-generated books through self-publishing platforms (Amazon KDP, IngramSpark, Draft2Digital, etc.)

    - Users are responsible for complying with the terms of service of distribution platforms

    - Some platforms may have specific requirements or restrictions for AI-generated content

    - Users should review platform policies before distributing AI-generated books


    #### Revenue & Royalties:


    - Users retain 100% of revenue generated from their AI-generated books sold on external platforms (Amazon, Apple Books, etc.)

    - Make It Write does not claim any royalties, publishing rights, or revenue share from commercial use

    - Users are responsible for paying applicable taxes on income from AI-generated books


    #### In-App Reading and Engagement:


    For books published within the Make It Write platform and read by other Make It Write users:


    Engagement Metrics:


    - Read Count Tracking: Track number of unique readers and total reads

    - Favorites & Bookmarks: Users can favorite or bookmark books

    - Reader Analytics: View reader engagement statistics (views, read time, completion rate)

    - No Revenue Sharing (Currently): Make It Write does not currently pay authors for in-app reads, but this may change in future versions


    Future Monetization (Planned):


    Make It Write may introduce creator monetization features in future updates, such as:


    - Per-read royalties similar to Kindle Unlimited

    - Tip/donation system for readers to support authors

    - Premium book sales within the app

    - Subscription revenue sharing for Super tier authors


    These features are not currently available. Users will be notified if monetization features are introduced.


    #### Restrictions on Commercial Use:


    - Users may not falsely claim AI-generated books were created entirely by human authors without AI assistance

    - Users may not resell or redistribute the AI generation service itself

    - Users may not use AI-generated books for illegal purposes or to promote harmful activities

    - Users must comply with all applicable laws and regulations in their jurisdiction

    - Users may not generate books that infringe on existing copyrighted works (see Section 6.6)

    ### 6.5 AI-Generated Content Legal Compliance & International Law


    #### 6.5.1 Compliance with Evolving AI Regulations


    International Legal Framework:


    Make It Write and all AI-generated content provided through the Service are subject to international, federal, state, and local laws governing artificial intelligence, intellectual property, and digital content, including but not limited to:


    - United States: Copyright Act (17 U.S.C.), AI Executive Orders, FTC regulations, U.S. Copyright Office AI guidance

    - European Union: AI Act (Regulation (EU) 2024/1689), Digital Services Act (DSA), GDPR, Copyright Directive (Article 13)

    - United Kingdom: AI Regulation Framework, Copyright, Designs and Patents Act 1988, Online Safety Act

    - Canada: Artificial Intelligence and Data Act (AIDA), Copyright Act

    - International Treaties: WIPO Copyright Treaty, Berne Convention, TRIPS Agreement

    - Emerging AI Laws: Country-specific AI regulations as they are enacted worldwide


    Current Legal Status:


    As of February 2026:


    - AI-generated written content is legally permitted for commercial use in most jurisdictions

    - Users may own or be granted rights to their creative input and generated outputs (varies by jurisdiction)

    - No current restrictions on AI book distribution or monetization in most countries

    - OpenAI and other AI providers comply with applicable copyright and AI laws

    - U.S. Copyright Office does not grant copyright protection to fully AI-generated works, but protects human-authored elements


    Subject to Change:


    - AI laws are rapidly evolving worldwide

    - New regulations may impose restrictions on AI-generated content

    - Copyright frameworks for AI outputs may be redefined

    - Commercial use rights may be affected by future legislation

    - Disclosure requirements may be mandated by law or publishing platforms


    Make It Write's Commitment:


    Make It Write commits to:


    1. Monitor international AI and copyright law developments continuously

    2. Comply with all applicable laws and regulations immediately upon enactment

    3. Adapt the Service to meet new legal requirements without delay

    4. Notify users of significant legal changes affecting their rights or usage

    5. Cooperate with regulatory authorities and legal investigations

    6. Educate users on evolving AI content regulations

    #### 6.5.2 User Acknowledgment & Agreement


    By Using Make It Write, You Acknowledge and Agree:


    Legal Changes:


    - AI laws are evolving and may change without notice

    - New regulations may affect your ability to use, distribute, or monetize AI-generated books

    - Make It Write is not responsible for legal changes imposed by governments or regulatory bodies

    - You may be required to disclose AI use on certain platforms or in certain jurisdictions


    Service Modifications:


    - Make It Write may modify, restrict, or discontinue features to comply with new laws

    - Changes may occur immediately if required by law or regulation

    - No advance notice may be possible for emergency legal compliance

    - We will notify users of significant changes when legally permitted


    User Responsibilities:


    - You are responsible for complying with AI and copyright laws in your jurisdiction

    - You must stay informed about legal changes affecting AI-generated content

    - You may not hold Make It Write liable for your failure to comply with applicable laws

    - You must disclose AI use where required by law or platform terms


    No Legal Advice:


    - Make It Write does not provide legal advice regarding AI content or copyright

    - You should consult a lawyer if you have questions about legal compliance

    - Our terms are not a substitute for professional legal counsel

    - Individual circumstances vary; seek legal advice for your specific situation

    #### 6.5.3 Refund Policy


    Make It Write generally does NOT provide refunds for subscriptions.


    Exceptional Refund Cases ONLY:


    Refunds will ONLY be provided in these exceptional circumstances:


    1. Complete AI Book Generation Service Stoppage

    - If our AI book generation service becomes completely unavailable for all users and cannot be restored within 30 days


    2. Complete Book Library Service Stoppage

    - If the Make It Write book library and reading service becomes completely unavailable for all users and cannot be restored within 30 days


    3. Legal Prohibition

    - If AI-generated content becomes illegal in your jurisdiction and you can no longer legally use the Service


    Refund Calculation:


    If one of the above exceptional cases occurs, refunds will be calculated on a pro-rated basis for the remaining subscription period only:

    Example:


    - Annual Super Subscription: $199.99

    - Service stops after 4 months used

    - Remaining months: 8

    - Total subscription months: 12

    What is NOT Refundable:


    You are NOT eligible for a refund for:


    - Change of mind after purchase

    - Dissatisfaction with AI-generated book quality

    - Minor service modifications or feature updates

    - Temporary service disruptions or scheduled maintenance

    - User violations of Terms of Service

    - Technical issues on user's device or internet connection

    - Third-party AI provider limitations (OpenAI, etc.)

    - Regional content restrictions or geographic limitations

    - Payment processor restrictions (App Store, Google Play)

    - Price changes or subscription tier modifications

    - UI/UX updates or design changes

    - Removal of non-core features

    - Legal compliance changes required by law

    - Platform policy changes (Amazon KDP, etc.)

    - Copyright disputes or third-party claims


    Important Refund Notes:


    - These are exceptional cases only. Refunds are not part of our standard policy.

    - Refund requests must be submitted within 30 days of the qualifying event

    - All refund decisions are final and at Make It Write's sole discretion

    - Refunds are processed to the original payment method within 14-21 business days

    - Once a refund is issued, your subscription will be immediately terminated

    - You cannot reuse the service after receiving a refund without purchasing a new subscription


    How to Request a Refund:


    If you believe you qualify for an exceptional refund:

    3. Include:

    - Account email address

    - Subscription tier (Starter, Creator, Super, etc.)

    - Date of subscription purchase

    - Amount paid

    - Specific reason (AI generation stoppage, library stoppage, or legal prohibition)

    - Supporting evidence (screenshots, error messages, legal documentation)


    Review Time: 5-7 business days

    Processing Time: 14-21 business days if approved

    ### 6.6 AI-Generated Content Disclaimer and User Responsibility


    #### 6.6.1 Nature of AI-Generated Books


    Make It Write uses artificial intelligence to generate book content based on user prompts and preferences. Our AI models are trained on large-scale collections of existing written works, as is standard practice in the AI content generation industry.


    Important Reality:


    AI-generated books may bear similarities to existing books, stories, plots, characters, narrative structures, or written works created by third-party authors or writers.


    We cannot guarantee that AI-generated content is entirely unique or free from similarities to pre-existing works.


    This limitation is inherent to ALL AI book generation services and is not unique to Make It Write. It is a known industry-wide reality.


    Why This Happens:


    - AI learns from existing literature to understand storytelling, character development, plot structures, and writing styles

    - Similar narrative structures are common across different books (hero's journey, three-act structure, etc.)

    - Certain tropes, archetypes, and themes are widely used in fiction (chosen one, love triangle, redemption arc, etc.)

    - AI cannot know every book ever written to avoid all similarities

    - Many stories share similar plots, character types, or thematic elements without violating copyright

    #### 6.6.2 Make It Write's Non-Liability for Third-Party Disputes


    Make It Write is NOT responsible for and shall NOT be held liable for any legal disputes, claims, or proceedings between:


    - Make It Write users and third-party authors or writers

    - Make It Write users and third-party copyright holders or publishers

    - Make It Write users and other individuals or entities claiming rights to similar written works

    - Make It Write users and other Make It Write users regarding content similarities


    This includes, but is not limited to:


    - Copyright infringement claims

    - Plagiarism allegations

    - Intellectual property disputes

    - Claims of plot, character, or narrative similarity

    - Derivative work claims

    - Any legal actions arising from the use, distribution, or commercialization of AI-generated books

    - Disputes over story structure, character development, dialogue, or thematic similarities

    - Third-party DMCA takedown notices or cease-and-desist letters

    - Claims from publishers, literary agents, or authors' estates

    - Trademark or character rights claims

    #### 6.6.3 User Responsibility and Indemnification


    By using Make It Write's AI book generation service, you acknowledge and agree that:


    You Accept Full Responsibility:


    1. You are solely responsible for how you use, distribute, or commercialize AI-generated books

    2. You understand that AI-generated books may have similarities to existing works

    3. You accept the risk that third parties may claim your AI-generated book is similar to their works

    4. You cannot hold Make It Write liable for any disputes, claims, or legal actions from third parties


    You Must Conduct Due Diligence:


    1. Before commercial publication, you should research whether AI-generated content is similar to existing copyrighted works

    2. You should run plagiarism checks using tools like Grammarly, Copyscape, or Turnitin

    3. You should consult a lawyer if you plan to monetize or widely distribute AI-generated books

    4. You are responsible for obtaining any necessary licenses or clearances

    5. You understand that Make It Write does not provide legal advice or copyright clearance services


    You Indemnify and Hold Harmless Make It Write:


    You agree to indemnify, defend, and hold harmless Make It Write, Differson LLC, its officers, directors, employees, affiliates, and agents from ANY claims, damages, losses, expenses (including legal fees), or liabilities arising from:


    - Your use of AI-generated books

    - Disputes with third parties regarding similarities to their works

    - Any commercial exploitation or distribution of AI-generated content

    - Allegations of copyright infringement, plagiarism, or IP violations related to your use of the Service

    - Claims from authors, publishers, literary agents, or other rights holders

    - Any legal proceedings, DMCA notices, or cease-and-desist letters you receive

    - Your failure to comply with applicable laws or third-party rights

    - Publishing platform disputes (Amazon KDP, Apple Books, etc.)


    What This Means:


    - If someone sues you for using AI-generated books, you CANNOT sue Make It Write

    - If someone claims your AI book is similar to theirs, Make It Write is NOT involved in that dispute

    - You must pay for your own legal defense and any damages awarded against you

    - You must reimburse Make It Write if we are dragged into your legal dispute

    #### 6.6.4 Realistic Expectations for AI Books


    Important: Similarity is Common and Expected


    Because AI is trained on existing literature:


    - Plot structures may match common narrative patterns used in thousands of books (hero's journey, coming-of-age, mystery formula, etc.)

    - Character archetypes may resemble popular character types (mentor, hero, villain, sidekick, love interest, etc.)

    - Thematic elements may align with universal literary themes (love, loss, redemption, betrayal, identity, etc.)

    - Story beats may follow standard storytelling conventions (inciting incident, rising action, climax, resolution)

    - Writing styles may resemble genre conventions (noir detective, epic fantasy, romance, thriller, etc.)

    - Dialogue patterns may follow natural human conversation structures


    This does NOT necessarily mean copyright infringement has occurred.


    Legal Reality:


    - Copyright protects specific expression, not general ideas, themes, or concepts

    - Many books share similar plots, characters, or themes without violating copyright

    - Similarity alone does not prove plagiarism or copyright violation

    - Courts require substantial similarity in protected expression, not just genre or style

    - Ideas, facts, tropes, and common literary elements are not copyrightable


    Make It Write's Position:

    OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MAKE IT WRITE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.


    Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

    ## 12. Termination & Account Suspension


    ### 12.1 Termination by Make It Write


    We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.


    Reasons for termination include:


    - Violation of content guidelines (Section 6.2)

    - Prohibited activities (Section 6.3)

    - Fraudulent payment or chargebacks

    - Harassment or abuse of other users

    - Use of automated tools or bots

    - Creating multiple accounts

    ### 12.2 Effect of Termination


    Upon termination:


    - Your right to use the Service will immediately cease

    ## 13. Dispute Resolution & Arbitration

    Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).


    Arbitration Terms:

    - The arbitration shall be conducted by a single arbitrator

    - The arbitrator's decision will be final and binding
