- AI Music Generation: Create original music tracks using AI technology (powered by Suno AI API and OpenAI GPT-4)
- AI Chat Assistant: Conversational interface for music ideation and creative assistance
- Vinyl Track Generator: Personalized song title and description generation based on user conversations
- Music Library: Browse, discover, and play music created by the community
- Music Distribution: Release your generated tracks to the McRock music library
- Streaming & Analytics: Track plays, followers, and engagement metrics
- Royalties System: Earn royalties based on streaming counts
- Payment Integration: Connect PayPal account to receive royalty payments

3. User Accounts
3.1 Registration
- You must create an account using Firebase Authentication (email/password)
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account credentials
- You must be at least 13 years old to use this Service
3.2 Account Responsibilities
- One account per user
- Do not share account credentials
- Notify us immediately of any unauthorized access
- You are responsible for all activities under your account

5. AI Music Generation
5.1 Third-Party AI Services
- Music generation powered by Suno AI API (api.sunoapi.org)
- AI chat powered by OpenAI GPT-4
- Vinyl track generation powered by OpenAI GPT-4
- Subject to third-party service availability and terms
5.2 Generation Limits
- Free users: Subject to usage limits
- Premium users: Higher generation limits (when applicable)
- Limits may be adjusted to ensure fair usage
5.3 Generation Time
- Music generation typically takes 30-60 seconds
- Processing time may vary based on service load
- Tracks are cached for 24 hours

6. Intellectual Property & Content Rights
6.1 User-Generated Content
- Music Tracks: You retain ownership of the creative input (prompts, lyrics, concepts)
- AI-Generated Output: Music generated by AI (Suno AI) may be subject to Suno AI's terms regarding ownership
- License to McRock: By generating music, you grant McRock a non-exclusive, worldwide, royalty-free license to host, store, distribute, and display your tracks within the App
6.2 Released Music
- When you release a track to the public library, you grant other users the right to stream and listen to your music
- You retain all commercial rights to your music
- You are responsible for ensuring your music does not infringe on third-party copyrights
6.3 Copyright Compliance
- You must not generate music that:
- Infringes on copyrighted material
- Uses trademarked names or brands without permission
- Copies existing songs or artists
- We reserve the right to remove infringing content without notice
- Repeat infringers will have their accounts terminated
6.4 Fair Use & Parody
- Parody and transformative works may be permitted under fair use
- You are responsible for determining fair use applicability
- We are not liable for copyright claims against your content

7. Royalties & Payment System
7.1 Royalty Calculation
- Royalties based on streaming counts ($0.003 per stream)
- Payment rates subject to change with reasonable notice
- Minimum available balance for withdrawal: $1.00 USD
- Available balance = Total earnings minus completed withdrawals
7.2 Payment Account Connection
- Users must connect PayPal account
- PayPal email must match McRock account email
- Manual verification by McRock before first payout
- Users must provide accurate payment information
7.3 Payout Process
- Manual Verification: McRock manually verifies payment accounts before processing withdrawals
- Processing Time: Payments processed within 1-2 months after withdrawal request
- Payment Method: Transfers made via PayPal
- Fees: Payment processing fees may apply (PayPal fees)
7.4 Payout Eligibility
- Account must be in good standing
- No violations of Terms of Service
- Valid and verified payment account required
- Minimum withdrawal amount: $1.00 USD
7.4a Withdrawal Eligibility Requirements
To request an earnings withdrawal, you must meet ALL of the following conditions:
- Active Subscription: Must have an active Creator Tier or Super Tier subscription at the time of withdrawal request
- Minimum Balance: Available balance must be at least $1.00 USD
- Verified Payment Account: PayPal account must be connected and verified by McRock
- Account in Good Standing: No violations of Terms of Service
- Email Match: PayPal email must match your McRock account email
Important Notes:
- If your subscription ends or is downgraded to Free/Premium tier, you will NOT be able to request new withdrawals until you resubscribe to Creator or Super tier
- Streaming counts and earnings continue to accumulate regardless of subscription status
- Pending withdrawal requests submitted while subscribed will still be processed even if subscription ends
- Accumulated earnings remain in your account and can be withdrawn once you resubscribe
- Only Creator and Super tier users can earn and withdraw royalties
7.5 Royalty Disputes
- Users may dispute royalty calculations within 30 days

- We will investigate and respond within 14 business days

8. Prohibited Conduct
You agree NOT to:
8.1 Content Violations
- Generate music with hate speech, violence, or illegal content
- Infringe on intellectual property rights
- Impersonate others or create misleading content
- Generate spam or malicious content
8.2 Technical Violations
- Attempt to bypass usage limits or restrictions
- Reverse engineer or hack the App
- Use automated systems (bots) without permission
- Interfere with service operation or security
8.3 Commercial Violations
- Resell or redistribute AI-generated music without proper rights
- Create fake accounts to manipulate streaming counts
- Engage in fraudulent payment activities
- Manipulate royalty calculations

9. Data Storage & Firebase
9.1 Cloud Services
- User data stored using Firebase Firestore (database: mcrock-database-real)
- Audio files and images stored in Firebase Storage
- Authentication managed by Firebase Authentication
9.2 Data Retention
- User accounts: Retained until account deletion
- Generated music: Retained for 24 hours (cached), indefinitely if released
- Conversation history: Retained for 90 days
- Analytics data: Retained for 1 year

10. Service Availability
10.1 Uptime
- We strive for 99% uptime but do not guarantee continuous availability
- Maintenance windows will be announced when possible
- Third-party service outages (OpenAI, Suno AI) may affect functionality
10.2 Service Modifications
- We may modify, suspend, or discontinue features at any time
- We will provide reasonable notice for significant changes
- No compensation for service modifications or interruptions

11. Termination
11.1 Termination by User
- You may delete your account at any time via Settings
- Unpaid royalties will be forfeited after 180 days
11.2 Termination by McRock
We may terminate your account immediately if you:
- Violate these Terms of Service
- Engage in illegal activities
- Abuse the service or harm other users
- Fail to pay required fees (when applicable)
11.3 Effect of Termination
- Access to the App will be revoked
- Generated content may be deleted
- Released music may remain in the library (per license granted)
- Unpaid royalties over $1.00 will be paid within 30 days (if eligible subscription tier is active)

- AI-generated music quality not guaranteed
- Results may vary based on input and AI service performance
- We are not responsible for the creative output of AI systems
12.2 Third-Party Services

- We are not liable for third-party service failures or terms
- Users subject to third-party terms of service

- Users responsible for ensuring music complies with applicable laws

These Terms are governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within the United States for the resolution of any disputes.
